Ⅰ.Special Reminder
We hereby remind you (Users) to read this User Service Agreement (hereinafter referred to as the "Agreement") carefully and ensure that you fully understand the terms of this Agreement before registering as a user of World Plan Logistics Platform (hereinafter referred to as the "WorldPlan"). Please read carefully and choose whether to accept this Agreement or not. After you agree and click to confirm the terms of this Agreement and complete the registration procedure, you can become the official registered user and enjoy various services of WorldPlan. Your actions including but not limited to registration, login and use will be deemed to accept this Agreement and agree to be bound by the terms of this Agreement. If you do not agree with this Agreement or have any doubt about the terms of this Agreement, please stop the registration procedure of WorldPlan immediately and choose not to use any service of this website.
This Agreement sets forth the rights and obligations of “WorldPlan” Services“ between WorldPlan and its users (hereinafter referred to as the "Services"). “Users” refer to the individuals and units that register, log in and use Services. This Agreement may be updated by WorldPlan at any time, and the updated terms and conditions shall supersede the original ones automatically once announced without notice. Users may check the latest terms and conditions in this mini program. If Users do not accept the modified terms, please immediately stop using the services provided by WorldPlan. It will be deemed as acceptance of the modified Agreement if Users continue to use the Services provided by WorldPlan after the Agreement are modified.
Ⅱ.Account Registration
1.Users need to register an account of “WorldPlan” before using the Services. The account of "WorldPlan" shall be registered by binding the mobile phone number. Users are required to register the account of "WorldPlan" by using the mobile phone number that has not been bound to any account of "WorldPlan" and has not been banned by WorldPlan according to this Agreement. “WorldPlan” may change the way of registering and binding the account according to the needs of Users or products without any prior notice to Users.
2.If the applicant has a precedent of being banned by WorldPlan or is suspected of false registration, the registration by abusing of other people's name, and other reasons not permitted, WorldPlan will reject his application for registration.
3.In consideration of the binding registration of "WorldPlan" account, you agree that WorldPlan will allow your mobile phone number, mobile device identification code and other information to be used for registration.
4.When users register and use the Services, WorldPlan shall collect personal information that can identify the Users so that WorldPlan can provide Users with a better experience or contact the User when necessary. The information collected by WorldPlan includes but is not limited to the user's name and address; WorldPlan agrees that the use of such information will be subject to the protection of User's personal privacy information in Article 3.
5.Information Provided by Users
(1) The mobile phone number provided by the User when registering an account or the nickname, profile picture and other public information authorized by the User to be obtained by WorldPlan when logging in through a third-party account (including but not limited to Alipay/Wechat /QQ/Weibo, etc.)
(2) Users name, contact information, contact address, ID number, settlement account (bank account) and other valid personal information submitted by Users according to the service requirements when using the Services ofWorldPlan; enterprise name, legal representative of the enterprise. Taxpayer’s identification number, registered address, registered telephone number and other relevant information of enterprise certification. Some Services of WorldPlan may require Users to provide specific corporate and personal sensitive information to implement specific functions. If Users refuse to provide this information, some specific functions in the Services may not be available. If Users voluntarily provide the enterprise certification information and sensitive personal information, it will be deemed that Users agree WorldPlan to process Users’ sensitive personal information in accordance with the purpose and manner stated in the Terms of Services.
Ⅲ.Account Security
1.Once registered successfully, the User will be given a user name and password of WorldPlan and has the right to login in with his/her user name and password at any time.
2.The User is fully responsible for the security of his or her User name and password and for all activities and events performed under his or her User name.
3.Users shall not transfer or authorize others to use their WorldPlan User names in any form.
4.Users shall keep the password properly and not inform others of the password. All losses caused by improper safekeeping of password shall be borne by the User himself.
5.If Users divulge the password, it may lead to adverse legal consequences. Therefore no matter what causes User password security to be compromised, please contact with WorldPlan customer service staff immediately, otherwise Users shall be liable for the consequences.
Ⅳ.Users Representations and Warranties
1.The User undertakes that he/she is a civil subject with full capacity for civil conduct and possesses the ability to conclude a transaction and fulfill its obligations.
2.Users are obliged to provide their real information for registration and guarantee the validity and security of contents such as mobile phone number, name, location, etc. to ensure that WorldPlan staff can contact Users through the above contact information. Meanwhile Users also have the obligation to update the relevant registration information in a timely manner when the information is actually changed.
3.Any content produced, uploaded, copied, published and transmitted by Users during the use of WorldPlan, including but not limited to the account profile picture, name, user description and other registration information and certificated information, or sending and replying of text, voice, picture, video, and related link page, or other contents generated when using the account or the Services, shall not violate the relevant national legal system, including but not limited to the following principles:
(1) Violating the basic principles set forth in the Constitution;
(2) Endangering state security, divulging state secrets, subverting state power or destroying state unity;
(3) Harming the state honor and interests;
(4) Inciting ethnic hatred or ethnic discrimination and undermining national unity;
(5) Undermining the state religious policy, preaching cult and feudal superstition;
(6) Spreading rumors, disturbing public order and destroying social stability;
(7) Spreading information about obscenity, pornography, gambling, violence, murder and terror or inciting crimes;
(8)Libeling or insulting others, and infringing legitimate right of others;
(9) Containing other contents prohibited by laws and administrative regulations.
4.Users shall not use the “WorldPlan” account or the Services to create, upload, copy, publish or spread any content that interferes with the normal operation of "WorldPlan" or infringes the legitimate rights and interests of other Users or third parties. The above mentioned content includes but is not limited to:
(1) The content contains any sexual or sexual connotations;
(2) The content contains abuse, intimidation or threat;
(3) The content containing information of harassment, spam advertisement, maliciousness and decoy;
(4) The content containing privacy, personal information or data of others;
(5) The content infringing the right of reputation, right of portrait, intellectual property, business secret or any legal rights of others;
(6) The content containing other information that interferes with the normal operation of the Services and infringes the legitimate rights and interests of other Users or third parties;
Ⅴ.Service Contents
1.WorldPlan mini program is an online booking and inquiry platform provided by World Jaguar Logistics (Tianjin) Inc. Users find suitable shipping space through the WorldPlan mini program and consign WorldPlan to take charge of booking and other Services. The specific service contents shall be provided by WorldPlan according to actual conditions, including but not limited to:
(1) Online searching and publishing information service;
(2) Matchmaking trading service;
(3) Sailing schedule inquiry, price inquiry and booking service;
(4) Subject to the statistics generated;
(5) Feedback on orders;
2.WorldPlan has the right to review or delete any content (including but not limited to text, voice message, picture, video, etc.) posted/disseminated by Users that is suspected of violating laws or socialist spiritual civilization or deemed inappropriate by WorldPlan.
3.The transaction information completed by users through WorldPlan shall be subject to the corresponding information published by the WorldPlan platform.
4.All announcements and other messages sent to Users can be sent through the mini program or the contact way provided by Users.
Ⅵ.Termination of Services
1.WorldPlan has the right to terminate the Service provided to Users under the following circumstances:
(1) In case of a User violates the relevant Terms of this Service Agreement, WorldPlan shall have the right to terminate the Service provided to such User; if this User registers as a user again directly or indirectly or in another person's name, WorldPlan shall have the right to directly and unilaterally terminate the Service provided to such User upon discovery;
(2) If WorldPlan finds that the contact information provided by the User during registration no longer exists or cannot be connected when WorldPlan staff contact the User through the information provided by the User, WorldPlan shall notify the User through other contact way to change his/her contact information. If WorldPlan is still unable to contact the User or the User fails to provide new contact information within three working days, WorldPlan shall have the right to terminate the Service provided to such User;
(3) Users are not allowed to create fake orders or cheat procedurally or artificially. If a User is found to have any cheating behavior, WorldPlan will terminate the Service to such User immediately;
(4) Once WorldPlan finds any false content in the data or information provided by the User, WorldPlan has the right to terminate the Service provided to the User at any time;
(5) Upon termination or renewal of Terms of Services, the User clearly express that he/she does not accept the new Terms of Service;
(6) (6) Other circumstances that WorldPlan deems necessary to terminate the Service.
2.Upon termination of the Service, WorldPlan is not obligated to retain any information in or related to the original account for Users nor forward any unread or unsent information to Users or third parties.
3.Users understand and agree that WorldPlan shall have the right to perform the following actions even after the termination of this Agreement and Services:
(1)Continue to save your user information;
(2) Continue to claim to Users the responsibilities they should bear generated by violating laws and regulations, this Agreement and the rules of the Platform when Users were using the Service of WorldPlan online booking Platform.
Ⅶ.Changes and Interruption of Services
1.In consideration of the special nature of the network Services, User agrees that WorldPlan will change and interrupt part or all of the network Services and delete (no longer retain) any information submitted by Users during the use of the network Services, for which WorldPlan does not need to notify Users or assume any liability to any User or any third party.
2.WorldPlanshall periodically or irregularly inspect or update the platform providing network Services, and WorldPlan shall not be liable for any interruption of network Services within a reasonable time due to such circumstances.
Ⅷ.Modification of Terms of Services
1.WorldPlan has the right to modify any content of its Terms of Services at any time. In case of any change in any content of Terms of Services, WorldPlan will prompt Users of the modified contents by appropriate means.
2.If the User does not agree with the modification of Terms of Services made by WorldPlan, the User has the right to stop using the network Services.
3.If the User continues to use the network Services, he/she will be deemed to have accepted the modification of Terms of Services made by WorldPlan.
Ⅸ.Disclaimer and Indemnity Statement
1.If WorldPlan has clearly expressed that its way to provide Services has changed and reminded Users of the matters to be noted, all consequences arising from Users' failure to operate as required shall be borne by Users themselves.
2.Users expressly agree that they shall bear all the risks and consequences arising from their use of WorldPlan.
3.Users agree to protect and safeguard the interests of WorldPlan and other WorldPlan Users. Users agree to be liable for damages or loss to WorldPlan and any other third party caused by Users’ any illegal, untrue, improper behavior or infringement of the legitimate rights and interests of third parties during the use of WorldPlan Services or Users’ violation of any provision of this Agreement.
4.Users promise not to make any commercial use of any data on WorldPlan Platform, including but not limited to using the data and related materials displayed on WorldPlan Platform by any means such as copying and spreading without the consent of World Jaguar Logistics (Tianjin) Inc.
5.Users promise not to interfere with the normal operation of WorldPlan network platform or any payment activities carried out on the WorldPlan net work by any means. Users promise not to take any action that would cause unreasonable large data load to be placed on WorldPlan network equipment.
6.World Jaguar Logistics has the right to unilaterally determine the nature of the User’s behavior and determine whether it constitutes a violation of this Agreement and/or Rules for the User’s behavior on WorldPlan, including the behavior that has not been carried out by the User on WorldPlan but has already had an impact on WorldPlan and other WorldPlanUsers, and impose appropriate penalties accordingly. Users shall keep all evidences related to their own actions and shall bear adverse consequences if they are unable to provide sufficient refutation or justification evidences.
7.If the User is suspected of violating relevant laws or provisions of this Agreement, causing any loss, claim from the third party, or punishment from any administrative department or judicial authority to WorldPlan, the User shall compensate WorldPlan for any loss and/or expenses incurred thereby, including but not limited to legal costs, counsel fees, notary fees, insurance fees and other relevant expenses.
Ⅹ.Privacy Statement
1.Scope of Application:
(1) The personal registration information provided by Users when they register the account of WorldPlan; the server value on Users’ browser that received and recorded automatically by WorldPlan when Users are using WorldPlan or visiting its related webpages, including but not limited to IP address and other data and webpage records requested to access to by Users.
2.Use of Information:
(1) WorldPlan will not sell or lend Users' personal information to anyone unless prior permission is obtained from Users; WorldPlan also does not allow any third party to collect, edit, sell or gratis disseminate Users' personal information by any means. If any User is found to be engaged in the above activities, WorldPlan shall have the right to immediately terminate the Service Agreement with such User and disable his/her account;
(2) For the purpose of serving Users, WorldPlan may use its Users' personal information to provide services to Users, including but not limited to sending information of products and services to Users. WorldPlan may share information with its partners so that they can send information of their products and services to Users.
3.Disclosure of Information: User's personal information will be disclosed in part or in whole under the following circumstances:
(1) Disclose Users information to third parties with the consent of Users;
(2) Disclose Users information to third parties or administrative or judicial organs in accordance with relevant provisions of laws or requirements of administrative or judicial organs;
(3) If Users violate relevant Chinese laws or website policies, the corresponding Users information is required to be disclosed to third parties;
(4)The Users information must be shared with the third party in order to provide the product and service required by Users;
(5) Other disclosure of information deemed as appropriate by WorldPlan according to laws or website policies;
(6) WorldPlan shall strictly perform the confidentiality agreement.
Ⅺ.Others
1.WorldPlan solemnly reminds Users to pay attention to the provisions of this Agreement which exempt WorldPlan from liability and limit Users' rights. Please read carefully and consider risks independently. Minors shall read this Agreement accompanied by their statutory guardians.
2.Once Users place an order on WorldPlan, it is deemed that the entrustment has been established and the settlement price is accepted by Users.
3.The validity, interpretation and dispute resolution of this Agreement shall be subject to the laws of the People's Republic of China. In case of any dispute or controversy between the User andWorldPlan, it shall be firstly settled through friendly negotiation. If no agreement can be reached through negotiation, the User agrees to submit the dispute or controversy to the people's court with jurisdiction in the place where World Jaguar Logistics (Tianjin) Inc. is located.
4.If any provision of this Agreement is invalid or unenforceable for any reason, the remaining provisions shall remain valid and binding upon both parties.
5.WorldPlan reserves the right of final interpretation and modification of this Agreement.
6.This agreement shall come into force on January 1, 2023.
